In this privacy notice, we describe how we process your personal data:

a) When you visit our website (the "Website");
b) When you interact with us on social media;
c) Through our drone flight planning and management software (the "Software") or other services we offer (collectively, "Services")
d) When you apply for a position with us;
e) When we receive your personal data for other purposes within the scope of our business activities.
2. Who is responsible for your personal data?
For the data processing described in this privacy notice, one of our two affiliated companies, Drone Harmony AG (Switzerland) and Drone Harmony Corp. (USA), is responsible. As a rule, Drone Harmony Corp. (USA) is responsible if you are located in the USA, Drone Harmony AG is responsible if you are located anywhere else.

We also process personal data as a data processor in performance of our contracts with our customers who use our Software ("Customers"). In this case, the relevant controllers (Customers) are primarily responsible to you for your personal data. Please note that certain private server Customers may apply different policies than those laid out in this privacy notice. In such a case, we ask you to contact the relevant controller (Customer) to provide you with its privacy information.

3. What personal data do we process?
3.1 When you visit our Website
When you visit our Website, the server automatically logs general technical information. This data includes, for example, the IP address, identifier, type, and operating system of your device, the type of browser you use to access our Website, the date and time of your visit, and the website you came from.

When you fill out our contact form, sign up for our newsletter or contact us in any other way through the Website, we collect the contact and other relevant personal data that you provide to us, as well as any technical data automatically generated in this context.
We may use the following cookies and other tracking technologies (for the sake of simplicity, collectively "Cookies"):

a) Technical and functional Cookies to ensure the functionality and security of our Website, and to make it easier for you to visit our Website;
b) Statistics Cookies to evaluate the use of our Website and to collect information to improve our products and services.

3.2 When you interact with us on social media
We maintain pages and profiles on popular social media platforms. When you interact with us on these platforms (e.g., by liking or commenting on our posts or sending us messages), we receive and process the corresponding data from you. In addition, the platforms provide us with certain information, such as statistics on the use of our content.

Please note: The operators of the platforms analyze your behavior and may combine this data with other information they already have about you. They also use this data for their own purposes and on their own responsibility, for example, for advertising, market research, or to further develop their services. You can find out more about how the respective platforms process your data in their privacy policies.

3.3 Through our Software
We process the following data through our Software:
a) Account data:
To use our Software, you need a Drone Harmony account ("DH Account"). During account registration, we collect personal data like your name, email, login information, etc.
We allow logging in to the Software using an existing third-party account (e.g., Google, Apple). If you register through such an account, we process the data you have agreed to make available, like your account ID, name, and email. You can generally control the data we receive from these sources using the privacy settings in your third-party account.
Once you are registered, by your choice, you may add more data to your profile by editing it.

b) Flight/inspection data and drone footage:
We process data on the flights/inspections performed as well as the drone footage collected, if this data is synchronized with our servers. This includes, as applicable, images, videos, live streams, flight plans, flight scene environments, flight logs, drone, flight, and inspection metadata, and inspection annotations.

c) Payment data:
If applicable (i.e., for paying DH Accounts), we process data with regard to the payments you make for your subscription, and we store your transaction history.
d) Technical data:
We process technical data resulting from your use of the Software. This includes usage data, location data, error logs, etc.

e) Communication content:
We also process communications that you send to us, such as your emails, support requests, feedback, and ideas.

If you use our Software in conjunction with software by one of our partners, your DH Account will be connected to the account you have with our partner, and we will process your data originating from that account. This data is collected by the respective partner and is provided to us under its own privacy policies.

We do not ask you to provide sensitive data, nor do we collect such data on purpose.

3.4 When you apply for a position with us
When you apply for a position with us, we collect and process the necessary personal data to review your application and conduct the application process. This includes, in particular:

a) Identification data and contact details (e.g., name, email, address, phone number);
b) Communication content;
c) Information about your professional background and qualifications;
d) The content of your application;
e) Other data necessary for the review of your application.

You submit most of this data directly to us as part of your application. In addition, we process data from other sources, in particular from references (if you have consented to references being obtained), as well as from publicly accessible sources (e.g., professional social networks, the internet).

If your application is successful, we will use the personal data collected during the application process and any data you provide us with after the application process to prepare and conclude our contract with you.

3.5 When we receive your personal data for other purposes within the scope of our business activities​
In the course of our business activities, we process personal data of other individuals, such as our contacts at potential and current customers, business partners, suppliers, and service providers. The personal data we process in this context primarily includes identification data, contact details, and communication content, as well as other relevant personal data.
We receive this data either directly from you or from other sources, such as your coworkers, our business partners, and other contacts, as well as from publicly available sources (e.g., the internet and professional social networks).

4. For what purposes and based on what grounds do we process your personal data?
We process the above-mentioned personal data for the following purposes and based on the following grounds for processing:

a) To enter into, fulfill, and enforce a contract. This includes, in particular, the contract for the use of our Software:
- with you, if we have concluded such a contract with you and process your personal data in fulfillment of this contract, or
- with our Customer who uses our Software.

b) Where legally permitted, based on our interests to communicate with you and third parties (including for other reasons than for the preparation or conclusion of a contract), to provide the Website and Software and optimize your user experience, to maintain and potentially expand our business relationship with you, to analyze demand patterns or conduct other evaluations, to improve, expand, and market our offerings, to ensure IT security and data protection, to prevent crimes and other misconduct, and to enforce, defend, or avert legal claims.

c) to comply with legal obligations, if applicable;
d) based on and within the scope of your consent, where applicable. You can revoke a consent you have given at any time with effect for the future.

Based on your consent or our interest in informing existing customers about new developments, we may send you marketing emails. To help us understand how you use our offers and customize them for you, we track whether and when you open these emails. You can prevent this in your email program by disabling the automatic download of images. Furthermore, you at any time have the option to refrain from receiving our marketing emails. However, as a Software user, you do not have the option to stop receiving administrative or service-related emails and notifications as they are necessary to provide the services you requested.

5. Children's Data
We do not knowingly collect, use, or disclose personal data from children under the age of 13. If we become aware that we have inadvertently gathered personal data from a child under the age of 13, we will take prompt measures to delete such data from our records. Parents or guardians who believe that their child may have provided us with personal data without their consent are encouraged to contact us immediately at contact@droneharmony.com.

6. When do we disclose your personal data to others?
To fulfill a contract, protect our interests, or comply with legal requirements, we may disclose your personal data to third parties. This includes, in particular, the following cases:

a)We engage IT service providers and other third-party service providers for the purposes described in this privacy notice.

b) Drone Harmony AG (Switzerland), provides IT, customer management, marketing, and administration services for Drone Harmony Corp. (USA).
​
c) If and to the extent you choose to use our Software in conjunction with the software of one of our partners, we share your personal data with them.
​
d) We may disclose personal data if and to the extent necessary to (i) comply with legal obligations, (ii) ensure IT security and data protection, or (iii) enforce, defend, or avert legal claims.

e) We may disclose personal data to third parties to whom we transfer our business or parts thereof, or with whom we merge.

In this context, we also transfer personal data between countries.
For personal data subject to Swiss or EU data protection legislation: We limit the transfer of personal data outside Switzerland, the EU, and the EEA as far as possible, but it cannot be entirely avoided. If the respective country does not have a level of data protection recognized by Switzerland/the EU, we use standard contractual clauses to ensure adequate data protection, where necessary and possible supplemented by additional security measures.

Hosting locations for personal data we process as a data processor are chosen by the relevant controllers (Customers).

We do not sell or rent personal data to third parties.

7. Data security
We protect your personal data with appropriate technical and organizational security measures against accidental, unlawful, or unauthorized manipulation, deletion, alteration, access, disclosure, use, or loss.

8. How long do we retain your personal data?
We store your personal data only for as long as and to the extent necessary for the purposes described or for legal reasons.
​
When you close your DH Account, the data stored in it is automatically removed from active systems unless continued retention is required for the purposes described above or for legal reasons. As a security measure to prevent data loss in the event of technical failures or unforeseen events, we create regular backups. Some data from closed DH Accounts may remain in these backups for up to 12 months before it is permanently deleted.

Note that we will not delete data stored in a DH Account that has not been closed, but only deactivated due to non-payment of the subscription fees. Please contact us at contact@droneharmony.com if you wish to close a DH Account that has been deactivated.

In some circumstances, we may anonymize your personal data for research or statistical purpose,s in which case we may use this information indefinitely without further notice to you.

9. What rights do you have in connection with your personal data?
If provided for and subject to the conditions of the applicable data protection law, you may have one or more of the following rights in connection with your personal data:

In these cases, we can or must reject certain requests or comply with them only to a limited extent.

We may request specific information from you to help us confirm your identity and ensure your right to access your personal data or to exercise any of your other rights. We may also contact you to request additional information, allowing us to respond to your inquiry more quickly.
If you have authorized an agent to exercise your rights on your behalf, the agent may contact us directly. Please note that we may need to collect additional information to verify the authority of your agent before processing your request.

We usually do not charge any fees if you request access to your personal data, but we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive.

10. Complaints
If you are not satisfied with how we process your personal data, please contact us so we can try to resolve your issue directly. The easiest way to contact us is by email at contact@droneharmony.com.

If provided for and subject to the conditions of the applicable data protection law, you have the right to file a complaint with your competent supervisory authority (in Switzerland: Federal Data Protection and Information Commissioner FDPIC). If we act as a data processor, the data protection authority competent for the relevant data controller may be responsible for your complaint.

11. How do we respond to Do Not Track signals?
We do not track you across third-party websites. Thus, we do not receive Do Not Track signals or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of our Website or Software.

12. Links to other websites
Our Website may link to third-party websites that are not operated or controlled by us. We are not responsible for whether and how these third parties comply with data protection regulations.

13. Changes to this privacy notice
We may modify this privacy notice from time to time. New versions become effective for you as soon as we notify you by publishing them on our Website.
